Prison Law is an area of law that looks after the rights of prisoners. Once a person is sentenced it becomes a worrying and distressing time for that person. The same is likely to apply whether you are a long-term prisoner or have only just been detained. Wilson O & Co Solicitors is delighted to help If you are concerned about what your rights and privileges are whilst detained.

Appeal against Conviction and Sentence

We will be happy to deal with issues such as appeals against convictions and sentence and Proceeds of Crime. We can also offer advice regarding categorisation.

The Procedure

following conviction or sentence for a criminal offence you had 28 days from the date of the conviction (if appealing against the conviction) or sentence (if appealing against the sentence) to submit an application for leave to appeal. You are still within the 28 days period. Wilson O & Co Solicitors will be able to assist in case you exceed this period without any appeal by your Solicitors. It is highly imperative that you contact us as soon as possible because you would otherwise be effectively time barred from seeking leave to appeal against your conviction and sentence.

Categorisation

We are delighted to assist you in the area of re-categorisation to follow sentence plans; assistance with complaints; and advise to foreign nationals and more.
Adjudications
We will also assist you and make representation during adjudications should you be subjected to ‘nickings’ for disciplinary behaviour.

Parole

We are able to further assist in relation to parole (for determinate and not determinate sentences) towards the end of your prison sentence. We are able to help you with our expertise knowledge in oral parole hearings, including for lifers, where advocacy assistance is often helpful in ensuring Early release.

Post release

We are also able to assist in relation to licence recall matters. We can help you to prepare representations or to represent in an oral hearing regarding your recall and any mitigation which may be provided.

Public Funding

Please note that Prison Law is funded under the CMR scheme which provides publicly funded assistance where the matter has sufficient merits and benefit to the individual, and where they do not have significant private funds of their own. This implies that the advice and assistance we will offer you will be free but subject to completion of some simple forms.
